These Terms and Conditions (“Terms”) govern your access to and use of the NFPA Fitness website (the “Site”), online certification programs, continuing education courses, digital study materials, and all related services (collectively, the “Services”). By purchasing, accessing, or using any NFPA Fitness Services, you agree to be legally bound by these Terms, as well as all applicable laws and regulations. If you do not agree to these Terms, you must not enroll in or use any NFPA Fitness Services.

Eligibility

You must be at least 18 years of age to enroll in any certification program or course. By registering, you represent and warrant that you meet this age requirement and that all information you provide is accurate, current, and complete. NFPA Fitness reserves the right to deny access or revoke enrollment if false or misleading information is provided.

Online Programs and Digital Materials

All NFPA Fitness certifications, courses, and study materials are delivered exclusively in an online format. Access to digital content is granted immediately upon purchase. Because of this instant access, all sales are final, and no refunds will be issued after purchase. You are solely responsible for ensuring that your computer or device meets the technical requirements to access and use online materials.

Account Responsibility

When you create an account with NFPA Fitness, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Sharing account access or distributing course materials to unauthorized individuals is strictly prohibited and may result in immediate termination of access without refund.

Payment Terms

By enrolling in an NFPA Fitness program, you agree to pay all applicable fees as stated at the time of purchase. Payment plans, when offered, are binding, and all installments must be completed in full. Failure to complete scheduled payments may result in suspension or termination of course access without refund. All fees are payable in U.S. dollars.

Refund Policy

Due to the nature of digital course delivery, all certifications, continuing education courses, and study materials are non-refundable once purchased. This includes all online content, downloadable resources, and exams. Payment plans remain binding and must be fulfilled in full, regardless of course completion status. NFPA Fitness reserves the right, at its sole discretion, to review and consider exceptions in cases of documented extenuating circumstances, but such exceptions are not guaranteed.

Certification Requirements

Successful completion of a certification program requires compliance with all course requirements, including completion of assigned modules, passing of exams, and adherence to stated timelines. NFPA Fitness reserves the right to determine and update certification standards at any time. Issuance of certification does not guarantee employment or future results, and NFPA Fitness makes no warranties regarding career outcomes.

Intellectual Property

All NFPA Fitness content, including but not limited to course materials, study guides, videos, practice exams, text, graphics, and logos, is the property of NFPA Fitness and is protected under copyright, trademark, and other intellectual property laws. You are granted a limited, non-transferable license to access and use the content for personal, non-commercial educational purposes only. Reproduction, distribution, modification, resale, or public display of any content without prior written consent from NFPA Fitness is strictly prohibited.

Code of Conduct

By participating in NFPA Fitness programs, you agree to act in a professional and respectful manner. Misuse of course materials, cheating on exams, harassment, or any activity that undermines the integrity of NFPA Fitness may result in immediate termination of access, revocation of certification, and possible legal action.

Limitation of Liability

NFPA Fitness provides all programs and materials on an “as is” and “as available” basis without warranties of any kind, either express or implied. To the fullest extent permitted by law, NFPA Fitness disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. In no event shall NFPA Fitness, its officers, directors, employees, or affiliates be liable for any damages arising out of or in connection with your use of the Services, including but not limited to indirect, incidental, consequential, or punitive damages, even if advised of the possibility of such damages.

Indemnification

You agree to indemnify, defend, and hold harmless NFPA Fitness and its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, or expenses (including attorneys’ fees) arising out of or related to your violation of these Terms or misuse of the Services.

Privacy

Your use of NFPA Fitness Services is also governed by our Privacy Policy, which explains how we collect, use, and protect personal information. By using the Services, you consent to the collection and use of your data in accordance with that policy.

Modifications

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Oklahoma, USA, without regard to its conflict of laws provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Oklahoma County, Oklahoma, and you consent to personal jurisdiction and venue therein.

Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms constitute the entire agreement between you and NFPA Fitness regarding use of the Services and supersede any prior agreements, representations, or understandings, whether written or oral.
